Please read these Terms of Service (“Terms”, “Agreement”) carefully before accessing or placing orders through our website, mobile interface, or retail outlet operated by S&Z Mobile (“S&Z Mobile”, “we”, “us”, or “our”).

By creating an account, browsing our catalog, adding items to your shopping cart, or completing a checkout purchase, you confirm that you have read, understood, and agreed to be legally bound by these Terms and our accompanying Privacy Policy. If you do not agree with any part of these Terms, you must discontinue use of our services immediately.

3.1 Age Requirements: You must be at least eighteen (18) years of age or possess legal parental/guardian authorization to enter into binding purchase contracts under Italian law (Art. 2 Codice Civile).

3.2 Account Security: If you register a customer account at /register, you are responsible for maintaining the confidentiality of your login credentials (email and password). You agree to notify us immediately of any unauthorized use or security breach of your account. S&Z Mobile is not liable for losses caused by unauthorized access resulting from your failure to keep your credentials confidential.

4. Products, Specifications & Pricing

4.1 Product Categories & Grading: We offer brand-new mobile phones, certified refurbished devices (Grade A+ with 70+ point hardware inspections), and official/certified mobile accessories (fast GaN chargers, cables, earbuds, MagSafe gear, and protective cases). Pre-owned grading descriptions accurately reflect cosmetic and battery health conditions.

4.2 Currency & Value Added Tax (VAT): All prices displayed on our website are in Euros (€ EUR) and are inclusive of Italian statutory Value Added Tax (IVA - 22%) where applicable.

4.3 Pricing & Typographical Errors: We strive for strict pricing accuracy. In the rare event that an item is displayed at an incorrect price due to a typographical or system error, S&Z Mobile reserves the right to cancel or refuse orders placed for the incorrectly priced product, with a full and immediate refund issued to the customer.

5. Orders, Payment Processing & Invoices

5.1 Order Formation: When you complete checkout, you receive an automated digital confirmation of order submission. The purchase contract is finalized when your payment is successfully authorized and your order is prepared for courier dispatch or made available for store pickup.

5.2 Payment Methods: We accept payments through:

• PayPal: Secure online checkout via PayPal balance, linked bank accounts, or stored cards.
• Credit / Debit Cards: Processed via PCI-DSS compliant payment gateways with 3D Secure / PSD2 authentication.
• Pay in Store: For in-store pickup orders at Via Vitruvio 47 Milano (cash, Bancomat, or POS cards).

5.3 Fiscal Documentation: A valid commercial receipt (scontrino fiscale) or electronic invoice (fattura elettronica) is issued for every transaction in accordance with Italian tax law (D.P.R. 633/1972).

6. Courier Delivery & In-Store Pickup

6.1 Express Courier Delivery: We ship across Italy via trusted express couriers (e.g. DHL, GLS, Bartolini). Delivery is typically completed within 1 to 2 business days from dispatch. Shipping is free on all orders over €150.

6.2 Free In-Store Pickup (Milano): You may choose free store collection at Via Vitruvio, 47, 20124 Milano. In-store orders are generally ready within 2 hours during store business hours (Monday–Saturday: 09:00–19:30). To collect your items, please present your order confirmation email and a valid government-issued photo ID.

6.3 Inspection Upon Delivery: Customers are urged to examine packages upon receipt for any visible damage to outer packaging and report any courier discrepancies within 48 hours.

7. 30-Day Money-Back Guarantee & Right of Withdrawal

7.1 Statutory Right of Withdrawal (D.Lgs. 206/2005): Under the Italian Consumer Code, consumer buyers have the statutory right to withdraw from an online distance purchase within 14 days of receipt without specifying any reason.

7.2 Refund Processing: Refunds are issued to the original payment method (e.g. PayPal or card refund) within 5 to 7 business days following receipt and technical inspection of the returned hardware at our Milan store.

8. 24-Month Hardware Warranty & Technical Support

8.1 Statutory & Store Warranty: All consumer purchases are backed by a comprehensive 24-Month Warranty (Garanzia Legale di Conformità pursuant to Articles 128 et seq. of the Italian Consumer Code).

8.2 Warranty Coverage: Our warranty covers internal hardware defects, motherboard malfunctions, display matrix failures, microphone/speaker faults, and charging port defects not caused by accidental damage or liquid ingress.

8.3 Exclusions: The warranty does not cover: accidental drops, cracked glass, liquid/water damage, unauthorized third-party tampering, unauthorized software rooting/jailbreaking, or standard battery wear beyond normal operating degradation.

9. In-Store Trade-Ins & Repair Lab

9.1 Device Trade-Ins (Ritiro Usato): Trade-in valuation quotes provided online or verbally are preliminary estimates. Final valuation requires physical inspection at our Via Vitruvio 47 store. Trade-in participants must be the lawful owners of the device and present a valid photo ID and fiscal code (Codice Fiscale).

9.2 Repair Diagnostics: Diagnostic evaluations at our tech lab provide transparent quotes before any physical repairs commence. Customers must back up personal device data prior to repair servicing.

10. Acceptable Use & Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Attempting to compromise website security, bypass authentication systems, or probe network vulnerabilities.
• Executing automated scrapers, crawlers, or high-frequency requests that impair server performance.
• Engaging in fraudulent payment testing, stolen credit card usage, or chargeback manipulation.
• Impersonating another person, business, or S&Z Mobile team member.
• Submitting false, malicious, defamatory, or abusive content in product reviews or support inquiries.

11. Product Reviews & User Content

Customers may post ratings and verified feedback on purchased phones and gear. By submitting reviews, you grant S&Z Mobile a non-exclusive, royalty-free license to display your review on the storefront. We reserve the right to moderate or remove reviews containing profanity, spam, false claims, or promotional links.

12. Intellectual Property Rights

All website designs, logos, software code, custom graphics, and written editorial content on S&Z Mobile are the exclusive property of S&Z Mobile or its licensors. Third-party brand names (such as Apple, iPhone, Samsung, Galaxy, Xiaomi, MagSafe) are the registered trademarks of their respective owners and are referenced solely for descriptive and compatibility identification purposes.

13. Technological & AI Disclaimers

Where automated search filters, smart recommendations, or AI-assisted catalog tools are utilized, product specifications and compatibility suggestions are provided as helpful guidance. Always verify specific technical model compatibility (e.g. wattage, pin configurations) prior to purchase.

14. Limitation of Liability & Disclaimers

To the fullest extent permissible by applicable law, S&Z Mobile provides its digital platform on an “as is” and “as available” basis. We do not warrant that digital access will be uninterrupted or error-free at all times.

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by gross negligence, willful misconduct, intentional fraud, or any statutory consumer rights that cannot be contractually waived under Italian Consumer Law.

15. Indemnification

You agree to defend, indemnify, and hold harmless S&Z Mobile, its directors, staff, and partners against any third-party claims, damages, liabilities, or legal expenses arising directly from your willful breach of these Terms, illegal conduct, or infringement of third-party rights.

16. Account Suspension & Termination

We reserve the right to suspend or terminate customer accounts or refuse current or future purchases if we identify fraudulent activity, abusive conduct, or material violations of these Terms. You may terminate your account at any time via the customer dashboard or by emailing support@szmobile.it.

17. Governing Law & Dispute Resolution

These Terms and any purchase agreements made through S&Z Mobile are governed by and construed in accordance with the laws of the Republic of Italy, with particular reference to Legislative Decree No. 206/2005 (Consumer Code) and Legislative Decree No. 70/2003 (E-Commerce Directive).

EU Online Dispute Resolution (ODR): Under Article 14 of Regulation (EU) No 524/2013, European consumers may also submit disputes to the European Commission's Online Dispute Resolution platform available at https://ec.europa.eu/consumers/odr.

18. Severability & Entire Agreement

If any provision of these Terms is determined by a competent judicial authority to be unlawful, void, or unenforceable, such provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. These Terms, together with the Privacy Policy and Order Confirmation, constitute the entire agreement between you and S&Z Mobile.
